- Za nesreću u Hrvatskoj primjenjuje se hrvatsko pravo (Uredba Rim II, čl. 4) — neovisno o tome gdje je vozilo registrirano.
- Odštetni zahtjevi u pravilu zastarijevaju za 3 godine od saznanja za štetu i počinitelja, a najkasnije 5 godina od nastanka štete (Zakon o obveznim odnosima).
- MOTOEXPERT izrađuje neovisno tehničko vještačenje štete: troškovi popravka, tržišna vrijednost vozila, umanjenje vrijednosti — na hrvatskom, njemačkom, engleskom i poljskom.
Prvi koraci nakon nesreće u Hrvatskoj
Osigurajte mjesto nesreće i pozovite policiju (192 ili 112) ako ima ozlijeđenih ili je odgovornost sporna. Ispunite Europsko izvješće o nesreći, fotografirajte položaj vozila, registarske oznake, oštećenja i policu osiguranja druge strane. Ako je druga strana strano vozilo, zapišite podatke sa zelene karte. Vlastita fotodokumentacija je ključni dokaz — snimite više nego što mislite da je potrebno.
Pravni okvir: mjerodavno pravo i rokovi
Za nesreću na hrvatskom teritoriju mjerodavno je pravo mjesta nesreće — hrvatsko odštetno pravo (Uredba Rim II, čl. 4). Oštećenik ima izravan zahtjev prema osiguratelju od automobilske odgovornosti štetnika (Zakon o obveznim osiguranjima u prometu). Odštetni zahtjevi u pravilu zastarijevaju za tri godine od saznanja za štetu i za osobu koja ju je prouzročila, a najkasnije pet godina od nastanka štete. Za štete koje prouzroče strana ili neosigurana vozila središnja institucija je Hrvatski ured za osiguranje (HUO), koji vodi i Garancijski fond.
Prekogranične štete: Hrvatska ↔ Njemačka i EU
Ako živite u Njemačkoj ili drugoj državi EU-a i doživjeli ste nesreću u Hrvatskoj (ili obrnuto — hrvatski državljanin s nesrećom u Njemačkoj), Direktiva 2009/103/EZ jamči da svaki osiguratelj u EGP-u ima ovlaštenog predstavnika za likvidaciju šteta u vašoj državi prebivališta. Zahtjev možete voditi od kuće, na svom jeziku. Mreža MOTOEXPERT više od 25 godina radi upravo na takvim prekograničnim predmetima, s posebnim iskustvom u njemačkom sustavu likvidacije šteta — što je važno za brojnu hrvatsku dijasporu u Njemačkoj i Austriji.
Što obuhvaća neovisna procjena štete
Neovisni stručnjak za procjenu štete na vozilima dokumentira štetu na dokazno siguran način i utvrđuje troškove popravka, tržišnu (nabavnu) vrijednost vozila, ostatak vrijednosti, umanjenje tržišne vrijednosti nakon popravka te po potrebi troškove zamjenskog vozila. Takvo vještačenje je tehnički temelj vašeg zahtjeva prema osiguratelju — neovisno o procjenitelju kojeg šalje osiguravajuće društvo.
